High Court Dismisses Survivor’s Petition to Cancel Report on Unauthorized Examination of Memory Card in Actress Assault Case

Kochi: The High Court has dismissed a petition filed by the survivor in the actress assault case, seeking the cancellation of an investigative report regarding the unauthorized examination of a crucial memory card. The survivor had requested that the trial court’s report be annulled and that a senior police officer investigate the matter. The High Court’s single bench rejected the petition, citing technical reasons. Justice C.S. Dias noted that new demands could not be raised in a previously settled petition and stated that the current petition was not legally tenable. The court mentioned that the complainant could seek other legal remedies.

The survivor’s petition alleged that the report from the Principal Sessions Judge was intended to protect judicial officers and court staff. It claimed that the report was prepared without proper inquiry and without seeking assistance from investigative agencies.

The survivor pointed out that explanations regarding the phone containing the memory card being lost or misplaced were not credible. She also alleged that the memory card was examined illegally while in the custody of three courts, including the Angamaly Magistrate’s Court, and that this had occurred at inappropriate times.
